GREENSBURG — A Western Pennsylvania judge tossed vehicular homicide and manslaughter charges against a man accused in the street racing deaths of two 19-year-old college students.

District Judge Michael Mahady said Matt Malinish, 23, wasn't responsible for the deaths of James Stulga of Irwin and Brian Shervin of Landisville in June 2008 in Greensburg.

Police said Stulga's Audi A4 was going as fast as 100 mph when it struck several trees. Stulga and Shervin were both thrown from the vehicle.

Mahady said Stulga and Shervin decided to speed and thus caused their deaths. The judge said there is no evidence Malinish caused them to crash.
