PITTSBURGH — A judge will decide next month whether to delay the trial of a man accused of killing three Pittsburgh police officers.

Assistant public defender Lisa Middleman wants the Oct. 12 trial date pushed back so co-counsel, Richard Narvin, has more time to prepare for the death penalty phase of Richard Poplawski's trial.

Middleman says she's found a suitable expert, but he's not available until September to review Poplawski's school, medical and other records for possible evidence about his past to oppose the death penalty should he be convicted.

Allegheny County Common Pleas Judge Jeffrey Manning did not immediately rule Monday, but instead scheduled another hearing June 28.

Poplawski allegedly shot and killed three Pittsburgh officers responding to a domestic dispute call from his mother in April 2009.

PHILADELPHIA — A 21-year-old New Jersey man is due in court on charges he intentionally vomited on a man and his 11-year-old daughter at a Philadelphia Phillies baseball game.Matthew Clemmens of Cherry Hill, N.J., is scheduled for an arraignment hearing today for the incident at a Phillies-Nationals game on April 14.Police say Clemmens and a companion began harassing Michael Vangelo, an off-duty police captain from Easton, and his daughters almost as soon as they reached their nearby seats.
