PITTSBURGH — An Allegheny County judge says money raised by a drink tax can only be used for the county's transit agency.

County Executive Dan Onorato had wanted to spend a $12 million surplus from the drink tax on road and bridge improvements. Opponents of the tax sued, claiming it's is strictly for mass transit.

On Friday, Judge Judith Olson agreed with opponents in an injunction.

Olson says the state law designating the money for transit is clear and unambiguous.

The county says it will appeal.

The controversial tax has been reduced from 10 to 7 percent because it generated far more than expected.

HARRISBURG — The Pennsylvania Revenue Department says its December collections ran $157 million below target.Six months into the state government's fiscal year, collections are $815 million less than projected.The latest figures, released Friday, show the state's general fund taking in 6.8 percent less than expected for the fiscal year that ends June 30.Sales, personal income, corporate income and inheritance taxes are all lagging behind.Dwindling state coffers have led to belt-tightening in Harrisburg and fueled a debate about whether to cut spending, draw down reserves or increase taxes.A 7 percent shortfall for the year would mean a $2 billion deficit in the state's $28.3 billion spending plan.

YORK — New Year's Eve arrived with a bang in south-central Pennsylvania.Authorities say a small earthquake jarred the York County area just after midnight Wednesday.The United States Geological Survey says the magnitude 2.4 quake was centered near Dillsburg and struck about 12:30 a.m.Mary Myers of Carroll Township told WHTM-TV that "it sounded like dynamite going off." Residents reported nearly two-dozen small tremors afterwardA series of earthquakes has been recorded in the area since October.

FREDONIA — A Western Pennsylvania prosecutor must decide whether to charge anyone in connection with a 10-year-old girl in critical condition after being shot in the head by her 15-year-old cousin.State police say the victim and the boy were home alone when he accidentally shot her about 6:30 p.m. Wednesday in Delaware Township. That's about 60 miles north of Pittsburgh where the girl remains at UPMC Children's Hospital.Mercer County District Attorney James Epstein and state police are set to meet Friday to discuss the case.Police have not described the handgun used in the shooting, nor have they said how the 15-year-old had access to it.

PITTSBURGH — Pittsburgh police say they've arrested seven adults and three juveniles after finding heroin and a gun in a home that neighbors had complained was the center of local drug activity.A SWAT team and plainclothes officers raided the home about 6 p.m. Thursday. Police say they used flash diversionary devices as they rushed into the home in the city's Elliott section.Police aren't releasing the names of the suspects until they can be positively identified. The 10 suspects remained in custody and are to be charged with drug trafficking and other offenses.Police say they found 600 dose bags of heroin, more than $7,000 in cash, a stolen 9 mm pistol and two scales in the home.
