Sentence Court

Butler County Judge William Shaffer handed down the following sentences Jan. 24:

Heather M. Blair, 49, of Butler was sentenced to five years of intermediate punishment for driving under the influence. Blair, who pleaded guilty Jan. 7, must also pay a $1,500 fine and serve 100 hours of community service. Blair was charged March 18 with three counts of DUI, driving an unregistered vehicle and operating a vehicle without financial responsibility.

David William Beattie, 34, of Lower Burrell was sentenced to six months of probation for driving under the influence. He pleaded guilty Jan. 7 after being charged on Aug. 2. Beattie must pay a $300 fine and serve 60 hours of community service. Five additional traffic violations were dropped.

Steven Wayne Whipple, 47, no address indicated, was sentenced to six months probation for simple assault. Whipple also was charged June 4, 2016, with false imprisonment, which was dropped Dec. 17, 2018 after he pleaded guilty to assault. In a second case, he was sentenced to six months of probation for presenting a false identification to law enforcement on Nov. 5, 2016. In a third case he was sentenced to a term of imprisonment of time served to one year. He was immediately paroled. He was also sentenced to six months of probation for terroristic threats and resisting arrest. On Aug. 21 he was originally charged with strangulation, terroristic threats, simple assault, resisting arrest, disorderly conduct and harassment.

James Lowell Fye III, 26, of Greensburg was sentenced to two years of intermediate punishment for driving under the influence, He must also pay a $300 fine and serve 100 hours of community service for damaging an unattended vehicle or property. Fye originally faced two DUI charges, two counts of traffic violations and two charges related to the property damage. Fye pleaded guilty to the reduced charges on Jan. 7. The charges were made on Aug. 12, 2017. In a second case, Fye was sentenced to five years of intermediate punishment for driving under the influence. The sentence will run separately from the first case. He pleaded guilty to a charge of driving with a suspended license. For the two charges, he must pay a total of $3,500, serve 90 days of house arrest and 150 hours of community service. In the original case, which dates back to Nov. 16, 2017, Fye faced three DUI-related charges and a possession of drug paraphernalia charge.

Andrew Thomas Berger, 45, of McKees Rocks was sentenced to 104 days of house arrest and six months probation for driving under the influence and possession of drug paraphernalia. Berger must pay a $1,000 fine and serve 100 hours of community service. Berger originally faced two counts of driving under the influence, possession a small amount of marijuana for personal use, possessing drug paraphernalia and two traffic violations.

Adam Richard Kelly, 36, of Lyndora was sentenced to a total of one to nearly three years in jail for statutory sexual assault and indecent sexual assault with a minor less than 13 years-old. Kelly pleaded no contest to the charges on Aug. 1, 2018. After his jail sentence, he will be on probation for 97 months, which is more than 8 months. Kelly will also be a registered sex offender for 10 years. He was originally charged on Jan. 17, 2016. He originally faced 17 charges, many of which date back to 2000. They are all related to sexual assault, including two counts of rape of a child.

Adrienne Marie Hurd, 38, of Butler was sentenced to two years probation after pleading guilty on Jan. 7 to two counts of simple assault. Hurd was originally charged Oct. 14 with two counts each of simple assault, reckless endangerment, resisting arrest, harassment and aggravated assault.

Joshua Adam Butler, 30, of Aliquippa was sentenced to three months to one year in jail after pleading guilty Dec. 17 to retail theft. Butler was charged March 17 with two counts of retail theft and receiving stolen property.

Stephen Joseph Willetts, 43, of Fenelton was sentenced to five days to six months of incarceration for driving under the influence. He received credit for time served and so was immediately paroled. He must serve 60 hours of community service. Willetts pleaded guilty Jan. 7. He was charged on July 12 with four counts of DUI and two traffic violations.

Cathy Diane Clark, 49, of Butler was sentenced to 60 months of intermediate punishment for driving under the influence. Clark must serve 50 hours of community service and pay a $1,500 fine. She pleaded guilty Dec. 7 and was originally charged Nov. 8, 2016. In a second case, Clark was given an identical sentence for driving under the influence but with a $2,500 fine. She pleaded guilty to the charge on Dec. 7. She was originally charged on Jan. 29, 2017 with four counts of DUI and six traffic violations.

David James Cummings, 59, of Butler was sentenced to six months of intermediate punishment, one year of probation and 90 days of house arrest for driving under the influence, fleeing or attempting to elude law enforcement and driving with a blood alcohol concentration greater than .02 percent with a suspended license. He pleaded guilty to the charges on Jan. 7. He must also pay a total of $9,750 in fines and serve 60 hours of community service. Cummings originally faced an additional DUI charge.

Michael Wesley Dienert, 32, no known address, was sentenced to one year of probation for disorderly conduct. He must also serve 20 hours of community service. He pleaded guilty on Dec. 17. He originally faced additional charges from Sept. 24 of harassment and simple assault.

Cynthia Ann Geist, 49, of Butler was sentenced to six months probation for driving under the influence and she must also pay a $950 fine and serve 60 hours of community service. She pleaded guilty on Jan. 7. Geist was originally charged on Oct. 4 with four DUI counts, a traffic violation and driving while operating privileges were suspended.
