Man jailed on charges he raped SRU student

SLIPPERY ROCK TWP — A man is accused of sexually assaulting a Slippery Rock University student after she fell asleep at her apartment, and later sent her a Snapchat message saying what happened was “wrong,” authorities said.

Samrajya B. Khadka, 20, whose last known address was in Oakland Township, turned himself in to authorities Friday at the office of District Judge Bill O'Donnell in Slippery Rock. He was accompanied by his attorney, T. Brent McCune of Pittsburgh, who characterized the defendant as a native of Nepal.

Last week, O'Donnell issued state police an arrest warrant for Khadka stemming from the alleged assault Jan. 16 at an off-campus apartment complex in Slippery Rock Township. The apartment is not affiliated with SRU.

O'Donnell arraigned the defendant on felony charges of rape of an unconscious person, involuntary deviate sexual intercourse of an unconscious person, sexual assault and aggravated indecent assault of an unconscious person.

He also is charged with a misdemeanor count of indecent assault of an unconscious person.

Khadka was later placed in the Butler County Prison on $200,000 bond. He also voluntarily surrendered his Nepalese passport, McCune said following arraignment.

Police said the defendant is not a student at SRU, and they could not say what he was doing in Slippery Rock.

The 20-year-old victim told police that Khadka and another man came to her apartment, and the three of them were watching movies when she believed she fell asleep on the couch, according to charging documents.

Around 4:45 a.m., police said, she awakened to find her pants pulled down and the defendant sexually assaulting her.

“The victim stated she has never been sexually active with Khadka,” documents said, “and did not give him permission to remove her pants and/or touch her intimate body parts.”

The woman recounted pushing the defendant off her and asking him what he was doing before she went to the bathroom and called a friend to help her.

At one point, police said, while the woman was talking to troopers at the Slippery Rock University police station, Khadka sent her a message via Snapchat, stating, “I said I'm sorry I feel like complete piece of (expletive). I'm ashamed whatever happened was wrong in (sic) so many levels.”

She was treated at Butler Memorial Hospital after the alleged assault, police said, noting she had scratches on her body, upper thigh and neck, but she did not know how she got the injuries.

Following Friday's arraignment, McCune said his client denied the woman was unconscious, and the defendant believed the acts were consensual.

“That's his position,” McCune said, referring to Khadka, whose preliminary hearing is scheduled for 2 p.m. Wednesday before O'Donnell.
