A 51-year-old man is accused of sexually assaulting a neighbor at their apartment complex in Slippery Rock.

Borough police Tuesday obtained an arrest warrant for Michael D. Bice on felony charges of rape of an unconscious person, involuntary deviate sexual intercourse of an unconscious person and two counts of aggravated indecent assault.

Police allege Bice assaulted the 63-year-old victim May 23 at the Madison Grove Apartments on Grove City Road. The defendant and woman both live at the complex in nearby apartments.

Another neighbor called authorities around 5:40 p.m. after hearing the victim yelling for help from her apartment. The caller later told police that she had seen the victim earlier that day at the defendant's apartment.

Bice, the woman and another man were drinking beer together and the victim appeared to be “highly intoxicated,” according to the witness' account, police said.

The suspect and the other man subsequently carried the victim into her apartment, the witness recounted.

Later, the other man left, but Bice remained in the woman's apartment. The witness said she eventually heard the victim calling, “Help me,” according to charging documents.

Police went to the apartment and found the woman alone. It looked like she was unconscious and naked from the waist down.

She subsequently awakened, police said, and appeared intoxicated. She later recalled having consumed two beers and a “sip” of moonshine at Bice's apartment.

“The victim stated she had no recollection of anything after this point,” documents said, “and prior to (being awakened) by the police.”

Police said Bice told them that he and the victim had been “partying” at his apartment. He later took her home, where he allegedly admitted they had consensual sex.

But the victim advised police that she “would not have given consent to Bice to have sex.”
