Freedom woman accused of DUI, kicking 2 officers

CRANBERRY TWP — A DUI stop turned into a felony charge after a Freedom woman allegedly kicked two police officers.

Leah Rose Testa, 29, faces charges of felony aggravated assault, misdemeanor charges of accident involving damage to an attended vehicle and driving under the influence of a controlled substance and summary charges of driving at unsafe speeds, operating an unregistered vehicle and operating a vehicle that is uninspected.

According to Cranberry Township police, Officer Edward Horan pulled over Testa after, he said, she rear-ended a pickup at a traffic light, pulled in front of the truck in traffic and didn't provide the driver with her insurance information. While pulled over in a Bank of America parking lot, Horan said he smelled alcohol on her breath.

Horan's affidavit states Testa “performed poorly” on field sobriety tests. Because of that, he wrote, he and another officer transported her to UPMC Passavant to perform a blood draw.

At the hospital, the affidavit reads, Testa kicked Officer Mark Shields in the thigh and ribs. When Horan “attempted to keep her from kicking” Shields, she kicked Horan in the leg and stomach, his affidavit states.

In the exam room, Testa continued to be uncooperative, Horan's affidavit states.

“I will not (expletive) give blood,” she said, according to the affidavit, before kicking the two officers again.

Testa was taken from the hospital without blood being taken, Horan's affidavit states. She remains in Butler County Prison in lieu of $15,000 bail. Online court records do not indicate if she is represented by an attorney.
