Man gets probation in road rage case that seriously hurt woman

A Butler man who ran a woman off the road — causing her serious injuries — was sentenced after a plea agreement was reached charging him with simple assault and reckless endangerment.

Butler County Judge William Shaffer accepted the plea deal, giving Domenic M. DeAngelo, 22, a total of 30 months of probation.

In January, Shaffer rejected a similar deal DeAngelo had agreed to after crash victim Heather Brinker, 22, of Slippery Rock had her statement read to the court.

In the statement, Brinker said she had “almost lost her life” after DeAngelo used his car to force her to drive into an embankment on the side of the road. DeAngelo's life “has not changed one bit, but my life has changed forever,” she said.

“I didn't cause this,” the statement continued. “I don't feel this is right, that this is being brushed off.”

Hearing this testimony, Shaffer said, “I am not inclined to accept a plea agreement in a case where the victim is not satisfied with the results.”

After the Sept. 27, 2015, crash, Brinker was taken to UPMC Presbyterian and underwent several surgeries for her injuries, police said.

If Shaffer had accepted that deal, DeAngelo would have been sentenced to 2 years probation, fines, restitution and court costs.

But on Thursday, Shaffer accepted a similar deal with identical charges and 18 months intermediate punishment, 12 months of county probation, an order to attend anger management classes and undergo drug and alcohol treatment. DeAngelo was also ordered to pay $5,000 in restitution to Brinker.

Shaffer declined to comment on why he had rejected the January deal yet accepted the latest one.

“His punishment wasn't harsh enough,” Brinker wrote in a message Thursday evening. “He should have received jail time for what he did.”

She said that she “only agreed” to the probation “because it's almost been three years and he wasn't going to get a harsher plea.”
