Plea, sentence are withdrawn in burglary case

A guilty plea and the corresponding sentence for a Clearfield Township man charged with burglarizing several businesses in the county were withdrawn Monday.

Patrick L. Duncan, 37, was charged last year with allegedly burglarizing several businesses, including the T-bar in Clearfield Township, the Dew Drop Inn in Donegal Township, the Slovak Club in Butler Township and McBride Station in Penn Township.

On Feb. 2 Duncan was sentenced to 9 to 18 months in Butler County Prison followed by probation, after pleading guilty to one count of felony burglary, two counts of felony criminal trespassing and several misdemeanors, according to court records.

However, the defense and prosecution in Butler County were unaware that at least one of Duncan's crimes happened during a probation period for a previous conviction, public defender Kim Hudak said Monday. After his sentencing, Duncan was recommitted to State Correctional Institution Mercer for the probation violation, she said.

President Judge Thomas Doerr granted the request by Hudak after hearing that assistant district attorney Laura Pitchford was in agreement.

The prosecution of Duncan's case will have to start over. A status conference is set for June.
