Plea withdrawl denied

A Butler man, sentenced to 11 months and 15 days in county prison, was denied a plea withdrawal in Butler County Court on Monday.

Joseph W. Zaborowski, 49, attempted to withdraw his plea after sentencing, but the motion was denied by county Judge William Shaffer.

Zaborowski's attorney, Joseph Hudak, argued that he and his client were under the impression that following sentencing on March 23, a state parole violation case in which Zaborowski was being detained would have no further action taken.

But after the sentence, the state parole board revoked Zaborowski's parole and sentenced him to “a large amount of additional incarceration.”

Zaborowski pleaded guilty to misdemeanor driving under intoxication, simple assault, fleeing or attempting to elude law enforcement and summary driving with a blood-alcohol content greater than 0.02 percent on a suspended license. He was sentenced to 11 months and 15 days to 23 months in county prison, as well as 18 months probation, $1,500 in fines and 100 hours of community service.
