Gun raffle winner charged by police

Check system stops acquisition

SUMMIT TWP — A raffle has turned into more than a hassle for an Ohio man.

Dale B. Schell, 54, of Masury was thrilled to learn he held a winning raffle ticket that he bought as part of a veterans group fundraiser.

In February, he traveled to Sportsman’s Supply in Summit Township to claim his prize — a .270-caliber Marlin rifle.

That’s where the story would take an abrupt turn.

State police said Schell lied when he filled out the federal Bureau of Alcohol, Tobacco, Firearms and Explosives form that was required to take ownership of the rifle.

He denied having been convicted of a felony or any misdemeanor charge that could bar him from possessing a firearm, according to court documents.

However, the Pennsylvania Instant Check system, which gun dealers use to determine if someone can legally buy or own a gun, blocked the would-be purchase due to Schell’s criminal record.

What got him into his trouble, according to court documents, was a 30-year-old burglary conviction in Mercer County that he failed to mention on the ATF form.

Police on Tuesday charged Schell with unlawfully attempting to buy a firearm, a felony, and making a false statement to authorities, a misdemeanor.

Authorities said Schell has agreed to turn himself in to police as soon as today.
